New Prague woman withdraws plea in light of new evidence 29 Sep 16

A New Prague woman who pleaded guilty in August to texting and driving that caused her to strike and kill an elderly man is withdrawing her plea in light of new evidence. Forty-eight-year-old Susan Russo pleaded guilty to reckless driving and misuse of a wireless communication device. She was expected to be sentenced in October to 4 days in jail and two years’ probation. Recently Russo’s attorney filed a letter to the court saying a report from the Bureau of Criminal Apprehension says Russo was not using her cellphone and had not deleted any cellphone records related to the time of the accident. The defense attorney is still working on filing motions to withdraw the plea.
