Driver accused of texting and driving in fatal crash 24 Sep 16

A driver who killed a Glencoe woman while texting and driving was charged with using a cell phone while driving. The more serious charge of vehicular homicide was dropped by Judge Timothy Looby because prosecuters  couldn’t prove without a reasonable doubt that 26-year-old Emily Givens of Hutchinson was texting and driving when she struck and killed 40-year-old Penny Verdeck in April of 2015. The issue was whether Givens had read two short text messages at the time of the crash. The analysis of her cell phone shows that the two messages were read, but Givens says that text messages automatically open when she uses her thumbprint to open the phone, and she had done that to change a Pandora radio station.
