A Madelia man going on trial this week for allegedly raping a 4-year-old girl is now facing another criminal sexual conduct charge for an incident with an underage girl in 2007. 29-year-old Edgar Arturo Cano-Fernandez has been charged with 6 felony counts for the incident with the 4-year-old, which allegedly occurred in January at a home in Lewisville. The new charge is actually the re-filing of a criminal sexual conduct charge that had been dismissed after authorities were unable to locate the victim. The girl was under 13-years-old when Cano-Fernandez was accused of sexually touching her. The victim and her family had returned to Texas after completing seasonal work in the region, however, but she has now been located and has agreed to testify. Cano-Fernandez is facing up to 30 years in prison for that case, and will be in court for an Omnibus Hearing on May 13th. He has a court appearance today (TUE) for the alleged rape of the 4-year-old, and a jury trial is set to begin on Thursday.
