The Minnesota Bureau of Criminal Apprehension is investigating the death of a 26-year-old Nicollet County man who stopped breathing while in police custody. Authorities say that Andrew Derek Layton of North Mankato was found passed out in a grocery store entryway in Mankato at just after 4:30am on New Year’s Day. Police say that when they woke Layton up he became combative, and an ambulance took him to the Blue Earth County Jail. Once at the jail, authorities found that Layton was not breathing and had no pulse. Lifesaving measures were taken and he was taken to a hospital. Layton died on Saturday at the Mankato Mayo Hospital. An autopsy is being performed, and the results are pending.
