A judge has denied a motion to dismiss the grand jury indictment against a 46-year-old man accused of killing another man with his father in rural Belgrade last year. The judge also denied a motion to suppress evidence in the case against Timothy John Huber. He and 82-year-old Delbert Huber are accused of fatally shooting Timothy Larson in October of 2011. He was killed following an argument apparently stemming in part from the Hubers’ farm equipment being parked at the Larson farm. The elder Huber pleaded guilty to second-degree murder in August and was sentenced to 367 months in prison. A pretrial hearing for Timothy Huber has been scheduled for December 18th. He remains in custody on $1-million bail, and could be sentenced to life in prison.
