A judge has denied a request from a Mankato eye doctor to have criminal sexual conduct charges against him dismissed. Todd Gavin had been accused of inappropriately touching female patients, as well as asking them to remove their clothes during eye exams while employed by the Mankato Clinic. He had been asking that 2 of the 6 criminal sex charges against him be dismissed due to lack of evidence. District Court Judge Bradley Walker ruled that a key point in the case was the fact that Gavin did not have an assistant with him when he examined 2 of the women. Doing so was required by the Mankato Clinic policies. The 51-year-old Gavin was reprimanded by the state in 2011 as well. He no longer works for the Mankato Clinic, but has started a business called Gavin Eye Consulting.
