Criminal Sex Sentence Challenged 16 Mar 12

A Sibley County judge has denied a request by former Sibley East Transportation Director Kevin Jones to have his criminal sexual conduct prison sentence reduced. The 50-year-old Jones was sentenced to 12 years in prison in June of 2009 for having a sexual relationship with a 15-year-old student. He had pleaded guilty to 1st-degree criminal sexual conduct, but contested that sentence after learning that he had been offered a plea deal he was supposedly never told about. The settlement would have called for Jones to plead guilty to 3rd-degree criminal sexual conduct, which would have led to a 4-year prison sentence. Sibley County Judge Thomas McCarthy denied the sentence reduction request, however, stating that at the time the plea deal was offered Jones had made it clear he would not accept any agreement that called for him to serve time in prison. The judge also noted that Jones was arrested for violating an Order For Protection the same day the plea deal offer expired. Jones remains in prison in Faribault. He will be released after 8 years with good behavior.
