A 19-year-old Sleepy Eye man was convicted of 4th-degree assault of a peace officer in Brown County Court on Monday. Sleepy Eye Police had responded to an out-of-control party behind the Sleepy Eye Laundromat in late October, and found that a sheriff’s deputy and another man were restraining Samuel Hernandez. As the officers attempted to handcuff Hernandez he allegedly made all 3 fall down a stairwell and hit the deputy in the face several times. He then reportedly vomited on himself and on the floor of a squad car before passing out. He had a blood-alcohol level of more than 3 times the legal limit for driving at the time. Hernandez pleaded guilty to the 4th-degree charge and misdemeanor assault and obstructing arrest charges were dismissed. He was sentenced to time served in jail, 109 days, as well as 3 years of supervised probation. He will also be required to attend anger management classes and remain law-abiding.
