A Madelia ophthalmologist accused of criminal sexual conduct with his patients is asking that 2 of the 4 charges against him be dismissed over a lack of evidence. 50-year-old Todd James Gavin was working for the Mankato Clinic when incidents involving 4 patients resulted in an investigation by the Minnesota Attorney General’s Office. One of the women claimed Gavin asked her to remove her clothing during an exam to see if a shingles outbreak had harmed her eyes. The second woman reported Gavin touched her breasts and her inner thigh after asking her to remove her clothing during an eye exam. The court will now investigate their medical records to see whether Gavin’s actions were necessary. The motion to dismiss the felony 4th-degree and gross misdemeanor 5th-degree criminal sexual conduct charges against him will be made during Gavin’s next court appearance on January 31st.
