Criminal sexual conduct charges against a Fairmont man were dismissed in court on Monday. Level 3 sex offender Troy Leroy Dykes had been accused of sexually assaulting a teenage girl while helping her and her mother move, but the case was dismissed because the accusations could not be proven beyond a reasonable doubt because the accuser’s story kept changing. A rape kit turned up male DNA other than Dykes’ as well. The case had been scheduled to go to trial in September, but the alleged victim told at least three different versions of what happened between her and Dykes. The court then learned about the girl having a history of lying and making accusations, and the charges against Dykes were dismissed. He is currently in custody in the Martin County Jail on a probation violation in an unrelated case.
